Minutes of the Zoning Board meeting held in the Town Hall lower level meeting room, 11 South Main Street, Pittsford, on March 6, 2002 and filed in the Town Clerk's office on:

ALSO PRESENT
Richard Williams Attorney, David Rowe Building Inspector, Sandie Freitag Secretary for the Zoning Board of Appeals
Chairman, Ed Starowicz, called the regularly scheduled meeting of the Zoning Board of Appeals to order at approximately 7 p.m. He gave a summary of the procedures to be followed for each public hearing, how the Board would deliberate, how public input would be taken, etc. He indicated that written comments are welcome until the public hearings are closed.

Requesting an Area Variance Code Section 185-39
Requiring all structures shall not exceed 30' in height.
The Public Hearing was opened for this application on January 23, 2002 meeting and at this time this board can not render a decision because the Planning Board has not prepared a SEQRA Resolution to submit to this board. If the Planning Board has the SEQRA Resolution prepared the decision of the Zoning Board of Appeals will be rendered on the March 18, 2002 meeting.

Woodland Estates (a.k.a. Gleason Estates)
Appealing decision of Code Enforcement Officer's interpretation of the Town of Pittsford's code regarding what constitutes as dormitory use.
Chairman, Ed Starowicz had opened the Public Hearing for 340 Gleason Circle, Woodland Estates on February 18, 2002 the Public Hearing was closed at that time.
Ed Starowicz asked the board members if there were any additional comments, there were none.
Ed Starowicz proceeded with the prepared resolution as written.

Requesting an Area Variance
Appealing decision of Code Enforcement Officer's interpretation of the Town of Pittsford's code regarding what constitutes dormitory use.
Ed Starowicz moved to uphold the decision of David Rowe, the Code Enforcer for the Town of Pittsford, the apartments rented from Woodland Estates through an agreement with St. John Fisher College is not considered a "dormitory" use. That there was not a change of use nor any changes to the character of the complex.
