Minutes of the Zoning Board meeting held in the Town Hall, lower level meeting room, 11 South Main Street, Pittsford, on February 26, 2003 and filed in the Town Clerk's office.

Chairman, David Rogachefsky, called the regularly scheduled meeting of the Zoning Board of Appeals to order at approximately 7 p.m. He gave a summary of the procedures to be followed for each Public Hearing, how the Board would deliberate, how public input would be taken, etc. He indicated that written comments are welcome until the Public Hearings are closed.
The board members would like to welcome Robert Shaddock to the board. Ed Starowicz has accepted a position in the Town of Pittsford, therefore, he has resigned as Chairman to the Zoning Board of Appeals.

Requiring a 30' front & 20' side setback.
Richard Williams, attorney, stated that because the applicant was not present the board would like to have all comments from the held until the March 17, 2003 meeting. At that time the applicant would be present to address all comments from the neighboring homeowners.
Comments from the Public:
There were comments from the public and surrounding the neighbors and they will be addressed at the next meeting.
Dave Rowe stated that the Architectural Review Board met on February 24, 2003 and granted approval for the exterior colors, window treatments, the sign lighting and the street lamps to be used in the plaza. See the following list:
Items approved by the board:
- The color scheme for the buildings was approved they are the Benjamin Moore paint colors of: taupe, white and soft gold siding, with white & gray trim, black and green 30-year shingles, which will match the Spring House roof that was installed about 1-1/2 years ago. There will be red brick for the pillar bases and along the bottom edge of the storefronts.
- The parking lot lighting: Sun Valley Lighting Catalog #23-1060-12'/LCZ-TR-V/PT/150 HPS with Base #2300, and Luminaries LCZ.
- Lighting for all tenants signs will be from Catalog 2000 "Baselite Corporation" Vol. 2, style #M710/50 E1/50.
Items from the board members for the architect to incorporate in the final design:
- On Buildings #1 & #2 install a decorative door for the second egress from the second floor on the east elevation along with a window next to the door. On the roof is a gable vent and the suggestion from the board members is to move this vent over slightly and center it over the proposed door and window on the first floor for both Buildings #1 & #2.
- Building #1 suggestion is to recess the foyer and bring the sidewalk along the front of the building with the overhang. With this change the patrons of the stores will not have to walk out from under the covered walkway, and will give an entrance look for the pedestrians and traffic from Monroe Avenue.
The Planning Board has granted Preliminary Approval and has done a SEQRA Resolution for the south side of Monroe Avenue of SpringHouse Commons. There are still some issues to be worked out regarding the final design. The Planning Board, Architectural Review Board and Historic Preservation Commission Boards are working with the architect to present a final design that will meet the Monroe Avenue Design Guidelines and the approval of all of the boards involved.
This Public Hearing remains open.

Requesting Area Variances

Requiring a 30' front & 20' side setback.
Dave Rowe has been in contact with the applicant and has requested him to table the application for the north side of Monroe Avenue until the Town Board renders a decision regarding the rezoning of the Auburn Trail area. At the present time a letter has not been received to table this application.
This Public Hearing remains open.
Comments from the Board Members:
Peter Webster commented that if the Town Board is still working with the applicant regarding this application the Zoning Board of Appeals should not be looking at it until the changes have been made. The requested variances in the present application no longer applies cause the size of the building will change per the request of the Planning Board's resolution states that Building #5 shall be no larger that 6,400-sq. ft. footprint and the parking ratio would increase to 90% of the required parking instead of the 75% that would have been available with the larger building. Instead of the 3-story high building that would be facing Oak Hill Country Club the building now would be a 1-1/2-story structure facing Monroe Avenue and a 2-story structure facing Oak Hill Country Club.

Rich Williams stated that with the request from the Planning Board to downsize the Building #5 in all probability some of the requested variances will not be required, and that some of the issues that the public would like to see addressed might be removed from the application when the applicant resubmits the revised plans.

Requesting an Area Variance

Requiring a maximum height of 30' for any structure or dwelling.
Bob Burgdorf, Nixon Peabody, just reviewed the application briefly for the third floor addition and the design of the roofline on Dorsey Hall dormitory. The additional space will allow for 84 beds for students to move onto campus. In all likely there will still be some students at the Woodland Estates but they hope to be able to get them moved onto campus. With the students living on campus and parking their cars near Dorsey Hall dormitory the parking problem for the commuting students will be better.
There were no comments from the public at this time.
This was just a short presentation for the board to review.
This was not a Public Hearing.
