ZONING BOARD MINUTES

Please take notice that the following public hearings were held by the Town of Pittsford Zoning Board of Appeals on Wednesday, January 18, 2006 in the Town Hall lower level meeting room, 11 South Main Street, beginning at 7:00 P.M. local time.

Chairman, David Rogachefsky, called the regularly scheduled meeting of the Zoning Board of Appeals to order at approximately 7:00 p.m.

Richard Williams read the Legal Notice was read at the November 21, 2005 meeting as published in the November 9, 2005, Wednesday edition of the Brighton Pittsford Post.

CONTINUED PUBLIC HEARINGS:

30 Burncoat Way
Tax #164.15-1-13
Requesting relief from Code Section 185-23 C (1) & (3), 185-127 C (2)
Requiring antennas shall be ground mounted only and to be located in the rear yard area.

Mr. Liu, owner of 30 Burncoat Way and Tony from Dish Network Services, outlined the locations that were reviewed for the placement of this satellite dish and they found that the trees along the back property line and in the back corner block the signal. The installer for the Network Services also looked into putting it on the roof and that was not feasible either. They would have to put it on a 5' - 8' pole over the roofline and with the high winds it was not a good idea and they don't if this location would get it above the tall trees in the backyard.
Mr. Liu stated that the trees that you see in the picture were his and that they found that the signal would not get over the trees and that this location was the only one that would work for the channels that they want to see. The dish channels are being used for educational reasons and not just for entertainment.

Comments and questions from the board members:

  1. Have they considered trimming the trees or taking them down to open up the signal line?
  2. What about attaching a pole to the chimney and lifting it up that way?
  3. How can the applicant be sure that if he trims the trees or takes the trees down that it will give him the results that he wants to achieve?
  4. If the dish is allowed to remain in the front of the house how low can you go to the ground and still receive the signal?
  5. Have you tried the back left hand corner of the property, it looks like there is plenty of property to work with?
  6. The back of the lot slopes up have you tried to place the dish at the back of the property?

Tony called the installer, Tom, and he stated that they did try other locations and even went onto the roof and was not successful in receiving the signal. Tony asked if they tried the back right corner and Tom was not sure if this would work because of the trees, they thought that the trees belonged to the neighbor and therefore they didn't try that location. As to lowering the pole 2' or 3' it could be done but with amount of snow we get in the area it would block the signal. He would not like to see the trees taken down for it would be quite expensive for the homeowner, the trees could be trimmed back but that may not work either. If the dish is allowed to remain in the front yard they would install evergreen trees around it so that only the people from the house could see it. Tony stated that they did not have a map of the property and when he goes out there again he will take the map and try different locations.

David Rogachefsky and Dave Rowe will meet the contractor out at the site and will try different locations to see if they can get the signals that are needed to receive the stations from China.
David Rogachefsky stated that the Public Hearing would remain open until the March 20, 2006 meeting to give the contractor time to review different locations and return to the board with a report of their findings. Seconded: Robert Shaddock

Mr. Liu stated that the e-mail from the neighbor regarding the location of the dish was not acceptable to her why wasn't she at the meeting so that she could understand the situation?

There were no additional comments from the board members or the public.
The Public Hearing remains open until the March 20, 2006 meeting.

Requiring a 20' side setback.

The applicant has requested a postponement until the March 20, 2006 meeting in order to work out the neighbor's concerns regarding the placement of the addition.
