Proceedings of a regular meeting of the Pittsford Town Board held on Tuesday February 20 2007 at 7:00 P.M. local time in Pittsford Town Hall.

PRESENT
Supervisor William A. Carpenter and Councilpersons Sandra F. Zutes, John J. Higgins, Jr., Karen W. Green, and John E. Bernacki, Jr.

ABSENT
There were no Town Board members absent.

ALSO PRESENT
Staff Members: Paul J. Schenkel, Commissioner of Public Works; Gregory J. Duane, Finance Director; Paul W. Wilson, Director of Recreation & Technology; Richard T. ATTENDANCE
Seven members of the public were in attendance.

Supervisor Carpenter called the meeting to order at 7:00 P.M. and invited everyone to stand for the Pledge of Allegiance.

PUBLIC COMMENTS
There were no public comments.

PUBLIC HEARING: PROPOSED LOCAL LAW 1 OF 2007: AMENDING ARTICLE I OF CHAPTER 133 OF THE TOWN OF PITTSFORD MUNICIPAL LAW ENTITLED TAXATION (TAX EXEMPTION FOR SENIOR CITIZENS WITH LIMITED INCOME)
The Supervisor verified publication of a legal notice for this public hearing and then opened the hearing for public comments. He noted that this local law would amend an existing law and would increase the maximum tax exemption allowance for senior citizens with limited income and that Monroe County and Pittsford School District have already adopted the increase.
There being no public comments, Supervisor Carpenter closed the public hearing.

 PROPOSED LOCAL LAW 1 OF 2007: AMENDING ARTICLE I OF CHAPTER 133 OF THE TOWN OF PITTSFORD MUNICIPAL LAW ENTITLED TAXATION (TAX EXEMPTION FOR SENIOR CITIZENS WITH LIMITED INCOME) APPROVED
The following Resolution was offered by Supervisor Carpenter, and seconded by Councilwoman Zutes,
RESOLVED, that Local Law No. 1 of 2007: Amending Article I of Chapter 133 Of The Town Of Pittsford Municipal Code Entitled Taxation - Partial Real Property Tax Exemption, be adopted by the Town Board of the Town of Pittsford, New York, to read as annexed hereto; and it was further
RESOLVED, that within twenty (20) days subsequent to the 20th day of February 2007, there shall be filed with the Secretary of State one certified copy of said Local Law No. 1 of 2007. (See Attachment A.)

PUBLIC HEARING: PROPOSED LOCAL LAW 2 OF 2007: AMENDING ARTICLE VII OF CHAPTER 133 OF THE TOWN OF PITTSFORD MUNICIPAL LAW ENTITLED TAXATION (TAX EXEMPTION FOR DISABLED CITIZENS WITH LIMITED INCOME)
The Supervisor verified publication of a legal notice for this public hearing and then opened the hearing for public comments. He also indicated that Monroe County and Pittsford School District have already adopted this increase.
There being no public comments, Supervisor Carpenter closed the public hearing.

PROPOSED LOCAL LAW 2 OF 2007: AMENDING ARTICLE VII OF CHAPTER 133 OF THE TOWN OF PITTSFORD MUNICIPAL LAW ENTITLED TAXATION (TAX EXEMPTION FOR DISABLED CITIZENS WITH LIMITED INCOME) APPROVED
The following Resolution was offered by Councilman Bernacki, and seconded by Councilwoman Green,
RESOLVED, that Local Law No. 2 of 2007: Amending Article VII of Chapter 133 Of The Town Of Pittsford Municipal Code Entitled Taxation - Real Property Tax Exemption for Disabled Persons, be adopted by the Town Board of the Town of Pittsford, New York, to read as annexed hereto; and it was further
RESOLVED, that within twenty (20) days subsequent to the 20th day of February 2007, there shall be filed with the Secretary of State one certified copy of said Local Law No. 2 of 2007. (See Attachment B.)

PUBLIC HEARING: PROPOSED ESTABLISHMENT OF THE MENDON CENTER ROAD WATER DISTRICT 1
The residents in the proposed water district have again requested an extension to complete looking into their options on this issue; therefore, this item continues to be tabled.

SUPERVISOR'S COMMENTS
Supervisor Carpenter extended his gratitude to the Operations Staff who worked so diligently during the last snowstorm to keep roads in Pittsford clean and clear.

MINUTES OF FEBRUARY 6 2007 APPROVED
The following Resolution was offered by Councilman Higgins, and seconded by Councilwoman Green,
RESOLVED, that the minutes of February 6 2007 Town Board meeting are approved as written.
ROLL CALL VOTE: Ayes: Zutes, Higgins, Green, Bernacki, and Carpenter. Nays: none. Declared carried.

RESOLUTION OF COMMENDATION: BOY SCOUT TROOP 336 EAGLE SCOUTS
The following Resolution was offered by Supervisor Carpenter, and seconded by Councilman Bernacki,
RESOLVED, the Town Board of the Town of Pittsford commends Anshu Chawla, and Ian Pfeiffer, of Boy Scout Troop 336 on successfully completing the requirements for the Eagle Scout Award, the most prestigious award the Boy Scouts can bestow upon a young man.
BE IT FURTHER RESOLVED, that special greetings are extended to Anshu Chawla and Ian Pfeiffer for the receipt of their Eagle Scout Award before family, friends and fellow scouts, which takes place on February 26, 2007.

RESOLUTION OF SUPPORT AND CONCURRENCE WITH THE MONROE COUNTY EMPIRE ZONE (FORMERLY ECONOMIC DEVELOPMENT ZONE) APPROVED
The following Resolution was offered by Supervisor Carpenter, and seconded by Councilman Bernacki, NOW, THEREFORE be it hereby RESOLVED, that the Town of Pittsford Town Board, in its capacity as governing body of the Town of Pittsford, does hereby support and concur with the County of Monroe Empire Zone to include the property more particularly described below as follows and fully supports and concurs in the submission of a regionally significant project application by the Empire Zone of Monroe County:
NOW, THEREFORE, BE IT RESOLVED, by the Town Board of the Town of Pittsford New York that it fully supports and concurs in the submission of an application by Magnetic Technologies Corporation for the re-designation of certain areas as an Empire Zone.

Note: Supervisor Carpenter indicated that the addition of this property to the Empire Zone does not affect local taxes.

2007 RECREATION SPRING PROGRAMS AUTHORIZED
The following Resolution was offered by Councilwoman Zutes, and seconded by Councilwoman Green,
RESOLVED, that the Town Board approves the 2007 Spring Recreation Program schedule. It is
FURTHER RESOLVED that the Supervisor is authorized to sign vendor contracts as required.
ROLL CALL VOTE: Ayes: Zutes, Higgins, Green, Bernacki, and Carpenter. Nays: none. Declared carried.

BID OPENING DATE SET: MAINLINE SEWER CAMERA INSPECTION SYSTEM
The following Resolution was offered by Councilman Bernacki, and seconded by Councilman Higgins,
RESOLVED, that the Town Board sets a bid opening date of March 27 2007 at 11:00 A.M. in the Department of Public Works for a new 2007 Mainline Sewer Camera Inspection System.
ROLL CALL VOTE: Ayes: Zutes, Higgins, Green, Bernacki, and Carpenter. Nays: none. Declared carried.

 BID OPENING DATE SET: JANITORIAL SERVICES FOR KINGS BEND PARK LODGES
The following Resolution was offered by Councilman Higgins, and seconded by Councilwoman Zutes,
RESOLVED, that the Town Board sets a bid opening date of March 14 2007 at 11:00 A.M. in the Department of Public Works for Janitorial Services at Kings Bend Park Lodges.
ROLL CALL VOTE: Ayes: Zutes, Higgins, Green, Bernacki, and Carpenter. Nays: none. Declared carried.

PITTSFORD LITTLE LEAGUE PARK VENDOR PERMIT AUTHORIZED
The following Resolution was offered by Supervisor Carpenter, and seconded by Councilman Bernacki,
RESOLVED, that the Pittsford Town Board authorizes the Town Supervisor to issue vending permits to Pittsford Little League allowing them to sell candy, soda, water, Gatorade, hot dog, hamburgers and sausage at the Habecker Fields on East Street, from April 1, 2007 through October 31, 2007.
ROLL CALL VOTE: Ayes: Zutes, Higgins, Green, Bernacki, and Carpenter. Nays: none. Declared carried.

DISCUSSION: CLOVER STREET/JEFFERSON ROAD IMPROVEMENTS
After discussion, the Town Board expressed their support for the Supervisor to send a letter to the NYS DOT Regional Director, Kevin O'Buckley, regarding concerns with the proposed Clover Street/Jefferson Road Improvement Project.
A copy of the letter will be sent to our community partners, and local, county and state officials.

SENIOR CENTER AND TOWN COURT COPIER MAINTENANCE AGREEMENT AUTHORIZED
The following Resolution was offered by Councilman Bernacki, and seconded by Councilwoman Green,
RESOLVED, that the Town Board authorizes the Supervisor to sign a one-year contract agreement for the Senior Center and Town Court copiers with Pittsford Eagle Systems Inc., each with a yearly payment in the amount of $192.00, for a total of both agreement in the amount of $384.00.

2007 MEMORIAL DAY BANDS AUTHORIZED
The following Resolution was offered by Councilwoman Zutes, and seconded by Councilman Bernacki,
RESOLVED, that the Town Board authorizes the Town Supervisor to sign vendor contracts, designed and approved by the Town Attorney, as needed with the entertainment providers on the list of performers submitted by the Director of Recreation and Technology for the 2007 Memorial Day Parade on May 28th, which is within the 2007 Budget established for the Memorial Day Parade.

2007 SUMMER CONCERT SERIES BANDS AUTHORIZED
The following Resolution was offered by Councilwoman Zutes, and seconded by Councilman Higgins,
RESOLVED, that the Town Board authorizes the Town Supervisor to sign contracts, designed and approved by the Town Attorney, as needed with the entertainment providers on the list submitted, with the exception of the RPO, by the Director of Recreation and Technology for the for the quoted dollar amounts, totaling $4,600.00, which are within the 2007 Budget established for the Summer Concert Series.

FOOD VENDOR AGREEMENT WITH BEN & JERRY'S AUTHORIZED FOR 2007 SUMMER CONCERT SERIES
The following Resolution was offered by Councilman Higgins, and seconded by Councilman Bernacki,
RESOLVED, that the Town Board authorizes the Supervisor to sign a food vendor agreement with Mike Brown of Ben and Jerry's to vend at the Port of Pittsford Park during the Summer Concert Series on June 8, 15, 22; July 6, 13, 20, 27; August 3, 10. It is
FURTHER RESOLVED, that the Town Board waives the vending permit fee for the 2007 Summer Concert Series.
ROLL CALL VOTE: Ayes: Zutes, Higgins, Green, Bernacki, and Carpenter. Nays: none. Declared carried.

2007 SPECIAL EVENTS BANDS AUTHORIZED
The following Resolution was offered by Councilwoman Green, and seconded by Councilman Higgins,
RESOLVED, that the Town Board accepts the list of musical performers for the Positively Pittsford Festival on Saturday June 9; the Pittsford Celebrates event on Saturday, September 15; the Family Halloween Fest on Sunday, October 28. It is
FURTHER RESOLVED that the Town Board authorizes the Town Supervisor to sign contracts designed by the Town Attorney, as needed, with the list of bands submitted by the Director of Recreation and Technology, not to exceed $12,000 which is within the 2007 Budget Established for the Positively Pittsford, Buffalo Bills Pep Rally, Pittsford Celebrates, and Family Halloween Fest events. It is FURTHER noted that The Skycoasters' contract is not developed by the Town Attorney, but is the same contract as in years past including 2006.

2007 SPECIAL EVENTS INFRASTRUCTURE AGREEMENTS AUTHORIZED

RESOLVED, that the Town Board authorizes the Town Supervisor to sign contracts as needed with Shea's Outhouse Services at a price not to exceed $1,100.00. It is
FURTHER RESOLVED, that the Town Board authorizes the Town supervisor to sign contracts with Intercept Security at a price not to exceed $3,500.00. It is
FURTHER RESOLVED, that the Town Board authorizes the Town Supervisor to sign contracts as needed with Geneva Tent & Awning at a price not to exceed $900.00 per event.

2007 SPECIAL EVENTS FOOD VENDOR CONTRACTS AUTHORIZED
The following Resolution was offered by Supervisor Carpenter, and seconded by Councilman Bernacki,
RESOLVED, that the Town Board accepts the list of food vendors for the Positively Pittsford festival on Saturday June 9 and the Pittsford Celebrates event on Saturday September 15 and authorizes the Town Supervisor to sign contracts, designed by the Town Attorney, as needed.

FIREWORKS CONTRACT WITH YOUNG EXPLOSIVES CORPORATION AUTHORIZED
The following Resolution was offered by Councilwoman Zutes, and seconded by Councilwoman Green,
RESOLVED, that subject to the Town Attorney review and approval, the Town Board for the Town of Pittsford authorizes the Supervisor to sign a contract with Young Explosives Corporation in the amount of $5,000.00 for a fireworks display for the September Celebrates event.

2007 FARM LEASES AUTHORIZED
The following Resolution was offered by Councilwoman Zutes, and seconded by Councilman Bernacki,
RESOLVED, that the Supervisor is authorized to execute farm leases with the following farmers, on the receipt of certificates of insurance, for the period of April 1, 2007 through December 31, 2007 in the amount of $25.00 per acre:

  • Robert Lehman, 12.5 acres in the Autumn Ridge Subdivision, 57.5 acres on the Royal Coach property
  • Larry Knickerbocker, 14.0 acres on Knickerbocker Road, 20.0 acres at Heather Heights, 15.0 acres on Laureldale Drive
  • Mark Kreiger, 7.0 acres on Tobey Road, 10.0 acres on Stone Road, 26.0 acres in the Isaac Gordon Nature Park, 21.0 acres on Willard Road
  • Mike Silco, 18.0 acres on Hedgewood Lane

2007 AGREEMENT WITH PITTSFORD YOUTH SERVICES AUTHORIZED
The following Resolution was offered by Councilman Bernacki, and seconded by Councilwoman Green,
RESOLVED, that the Town Board of the Town of Pittsford authorizes the Supervisor to enter into a contract with Pittsford Youth Services.
ROLL CALL VOTE: Ayes: Zutes, Higgins, Green, Bernacki, and Carpenter. Nays: none. Declared carried.

SEMINAR ATTENDANCE AUTHORIZED
The following Resolution was offered by Councilwoman Green, and seconded by Councilman Higgins,
RESOLVED, that the following individuals are approved to attend the following seminar and/or conference:

  • Highway Department and Sewer Department employees John Schojan, Jeff Doll, Rick Laing, John Boscoe, Jeff Cooper and Mike Gulnac to the Dig Safely Excavator Seminar in Perinton on 3/15/07 at no cost to the Town of Pittsford.
  • Robert Fromberger to the Storm Water Management Seminar in Batavia on 03/12/07 at no cost to the Town of Pittsford.

FEBRUARY 2007 VOUCHERS APPROVED
The following Resolution was offered by Councilman Higgins, and seconded by Councilwoman Zutes,
RESOLVED, that February 2007 vouchers No. 76366 through No. 76790 in the amount of $2,571,651.65 are approved for payment.

FEBRUARY 2007 BUDGET TRANSFERS AND AMENDMENTS APPROVED
The following Resolution was offered by Councilman Higgins, and seconded by Councilwoman Zutes,
RESOLVED, that February 2007 Budget Transfers and Amendments are approved as per Attachment C.
