Proceedings of a regular meeting of the Pittsford Town Board held on Tuesday, February 19, 2008 at 7:00 P.M. local time in Pittsford Town Hall.

PRESENT:
Deputy Supervisor Sandra F. Zutes, and Councilpersons John J. Higgins, Jr., Karen W. Green, and John E. Bernacki, Jr.

ABSENT:
Supervisor William A. Carpenter

ALSO PRESENT:
Staff Members: Gregory J. Duane, Finance Director; Jessie Hollenbeck, Recreation Supervisor; Richard T. Williams II, Town Attorney; Patricia E. Chuhta, Town Clerk.

ATTENDANCE:
Ten members of the public were in attendance.

Deputy Supervisor Zutes called the meeting to order at 7:00 P.M. and invited everyone to stand for the Pledge of Allegiance.

PUBLIC COMMENTS
There were no public comments.

PUBLIC HEARING: KENSINGTON WOODS NORTH PHASE I (SUMMERS CIRCLE) PARK DISTRICT
After verification of publication of a legal notice, Deputy Supervisor Zutes indicated that this public hearing is being held to hear comments regarding a Park District that has been requested in the Kensington Woods North, Phase I, subdivision for Summers Circle. She noted that those in the Park District would be responsible for the district costs. Deputy Supervisor Zutes then opened the hearing to public comments.

There being no public comments, the public hearing was closed.

KENSINGTON WOODS NORTH PHASE I (SUMMERS CIRCLE) PARK DISTRICT APPROVED
The following Resolution was offered by Councilman Bernacki, and seconded by Councilwoman Green,
RESOLVED AND ORDERED, that

  1. The Petition is signed and acknowledged or approved as required by law and is otherwise sufficient;
  2. All the property and property owners within the District are benefited thereby;
  3. All the property and property owners benefited are included within the limits of the District;
  4. The expenses of Maintenance of the District are to be paid by the property owners annually on an ad valorem basis; and
  5. It is in the public interest to grant in whole the relief sought; and it is further

RESOLVED AND ORDERED, that the "Kensington Woods North Phase I (Summers Circle) Park District", be and the same hereby is created, and that the boundaries of the Park District, as hereby created, are as set forth in "Exhibit A" annexed hereto, and as further set forth on the map annexed hereto as "Exhibit B", with the maintenance of such Park District, by the Town, to be in accordance with the Maintenance Schedule annexed hereto as "Exhibit C".
ROLL CALL VOTE: Ayes: Higgins, Green, Bernacki and Zutes. Nays: none. Resolution declared carried.

ALL THAT TRACT OR PARCEL OF LAND containing 22.801 acres, more or less, situate in the Phelps and Gorham Purchase, Township 12, Range 5, Town Lots 48 & 50, in the Town of Pittsford, County of Monroe, and State of New York, as shown on the drawing entitled "Kensington Woods, North Park District Plan," prepared by BME Associates, having drawing number 2045D-29, last revised October 26, 2007, being more particularly bounded and described as follows:

Beginning at the intersection of the northerly right-of-way line of Lehigh Station Road (New York State Route 253) (49.5' Right-of-Way) with the easterly boundary line of Lands now or formerly of Jimmie C. and Juanice Morgan (T.A. No. 177.01-02-007)' thence

N20º57'04"E, along said easterly boundary line of Lands of Morgan, a distance of 322.14 feet to the northeast boundary corner thereof, thence

Continuing maintenance beyond the foregoing Maintenance and Warranty period will become the responsibility of the Town of Pittsford. The Town will reserve discretion to determine the level of maintenance required, on an ongoing basis, reasonably consistent with the following:

Maintenance Areas "A", "B", "C"

Manicured Lawn - a minimum of 35' width from roadways receive mowing and trimming to properly maintain 2½" height, 3 applications of fertilizer at a rate of 1 lb. nitrogen per 1,000 square feet annually. Weed and insect control shall be applied as necessary.
Entrance monuments/signs/fences - shall be maintained, repaired, replaced and/or removed as determined by the Pittsford Department of public Works.
Planting Beds - receives monthly weed control, annual edging to maintain a "V" shaped separation from the manicured lawn area, and annual reapplication of mulch.
Plant Materials - receives annual pruning as necessary. Insect and disease control shall be applied as necessary.
Within the five (5) year period following Developer's warranty period, dead or declining plant material shall be replaced with like plants.

PUBLIC HEARING: EXTENSION #9 TO THE 1-2 POLE LIGHTING DISTRICT FOR KENSINGTON WOODS NORTH SUBDIVSION PHASE I (AKA SUMMERS CIRCLE)
The Deputy Supervisor verified publication of a legal notice for this public hearing and discussed the proposed Lighting District extension. She noted that the extension costs will be paid by the property owners in the extension. Deputy Supervisor Zutes then opened the hearing to public comments.

There being no public comments, the public hearing was closed.

EXTENSION #9 TO THE 1-2 POLE LIGHTING DISTRICT FOR KENSINGTON WOODS NORTH SUBDIVISION PHASE I (AKA SUMMERS CIRCLE) APPROVED
The following Resolution was offered by Deputy Supervisor Zutes, and seconded by Councilman Higgins,
RESOLVED, that

  1. The Petition is signed and acknowledged or approved as required by law and is otherwise sufficient;
  2. All the property and property owners within the Extension are benefited thereby;
  3. All the property and property owners benefited are included within the limits of the Extension;
  4. The expenses of the entire District, including the within Extension, are to be paid by the property owners of the District, annually, on a benefit basis; and
  5. It is in the public interest to grant in whole the relief sought; and it is further

RESOLVED AND ORDERED, that "Extension No. 9 - "Kensington Woods North Subdivision Phase I (Summers Circle)", be and the same hereby is created, as part of the "Pittsford Consolidated Lighting District 1---2 Poles" and that the boundaries of the said Extension, as hereby created, are as set forth in "Exhibit A" annexed hereto, and as further set forth on the map annexed hereto as Exhibit B.

MINUTES OF FEBRUARY 5 2008 APPROVED
The following Resolution was offered by Councilman Higgins, and seconded by Councilwoman Green,
RESOLVED, that the minutes of February 5 2008 Town Board meeting are approved as amended.
ROLL CALL VOTE: Ayes: Higgins, Green, Bernacki and Zutes. Nays: none. Resolution declared carried.

RESOLUTION OF COMMENDATION: OUTGOING EAST ROCHESTER FIRE CHIEF RAY CERRETTI
The following Resolution was offered by Councilwoman Green, and seconded by Councilman Bernacki,
RESOLVED, that the Pittsford Town Board of the Town of Pittsford express their congratulations and gratitude to Ray Cerretti for his faithful and dedicated service to his community.
ROLL CALL VOTE: Ayes: Higgins, Green, Bernacki and Zutes. Nays: none. Resolution declared carried.

SPRING 2008 RECREATION PROGRAMS AUTHORIZED
The following Resolution was offered by Councilman Bernacki, and seconded by Councilwoman Green,
RESOLVED, that the Town Board approves the list of Spring 2008 Recreation programs and authorizes the Supervisor to sign vendor contracts as required.
ROLL CALL VOTE: Ayes: Higgins, Green, Bernacki and Zutes. Nays: none. Resolution declared carried.

RENEWAL OF INTERMUNICIPAL COOPERATION AGREEMENT WITH PITTSFORD SCHOOLS AUTHORIZED
The following Resolution was offered by Councilwoman Green, and seconded by Councilman Bernacki,
RESOLVED, that the Town Board of the Town of Pittsford authorizes the Town Supervisor to enter into and sign the proposed Intermunicipal Cooperation Agreement with the Pittsford Central School District.
ROLL CALL VOTE: Ayes: Higgins, Green, Bernacki and Zutes. Nays: none. Resolution declared carried.

Note: The expiration date for this agreement renewal is August 31, 2013.

SEMINAR ATTENDANCE AUTHORIZED
The following Resolution was offered by Councilman Bernacki, and seconded by Councilman Higgins,
RESOLVED, that the following individuals are approved to attend the following seminar and/or conference:

  • Recreation Supervisor Jessie Hollenbeck to the NYS Recreation & Parks Society's Annual Conference in Saratoga Springs on March 30 through April 1 2008 at a cost of $417.00.
  • Deputy Library Director Liz Barrett to the PERMA Regional Meeting on Wellness and Workers Compensation in East Aurora on March 13 2008 at no cost.
  • Deputy Town Clerk Karen Ward to the 2008 NYS Town Clerks Association Annual Seminar in Saratoga Springs on April 27 to 30 at a cost of $160.00

ROLL CALL VOTE: Ayes: Higgins, Green, Bernacki and Zutes. Nays: none. Resolution declared carried.

FEBRUARY 2008 VOUCHERS APPROVED
The following Resolution was offered by Councilman Higgins, and seconded by Councilwoman Green,
RESOLVED, that February 2008 vouchers No. 81472 through No. 82019 in the amount of $2,809,184.38 are approved for payment.
ROLL CALL VOTE: Ayes: Higgins, Green, Bernacki and Zutes. Nays: none. Resolution declared carried.

As there was no further business, the Deputy Supervisor adjourned the meeting at 7:20 P.M.
